These terms govern the design and development services offered by David Elliott, a sole proprietor operating at heydavidelliott.com, including monthly subscriptions and fixed-price Sprints. By subscribing or booking a Sprint, you agree to these terms.
I offer three subscription tiers:
All plans are billed on a 31-day cycle at a flat monthly rate.
Once subscribed, you submit requests and I work through them based on your priority. Depending on your plan, you can have one or two active requests at a time. Revisions are always included until you're happy with the result. Communication is async by email, with direct chat and video updates on Standard and Design + Build.
A Sprint is a one-time project with a fixed scope and a fixed price. It is not a subscription and does not renew.
Scope. Before any work starts, we agree in writing on what the Sprint will deliver. The fixed price covers that scope. If you want something outside it, I'll tell you before doing the work, and we can add it for a separate quote or save it for after launch. Nothing is added to your bill without your agreement.
Payment. 50% of the Sprint price is due to book your start date, and the remaining 50% is due at launch, before final handoff of files, code, and account access.
Timeline. Timelines are estimates and depend on timely feedback, content, and access from you. If feedback or materials are delayed, the launch date moves by the same amount. If a Sprint is paused on your side for more than 30 days, I'll schedule the remaining work at the next available opening.
Post-launch fixes. During the included fix period, I'll correct anything that doesn't work as agreed. New features and changes to the agreed scope are new work.
Third-party costs. Domains, hosting, and any paid services your project uses are set up in your own accounts and paid by you directly.
You can pause your subscription at any time. Billing cycles are based on a 31-day period, so unused days carry over when you resume. You can also cancel anytime — there are no long-term contracts or commitments.
Subscriptions. Due to the nature of the work, refunds are not offered. However, you can pause or cancel at any time, and I'm committed to making sure you're satisfied with the output.
Sprints. The deposit is non-refundable once work has started. If you end a Sprint early, the deposit covers the work done so far, no further payment is due, and you receive everything completed up to that point.
You own all deliverables upon payment in full. Every file, asset, and line of code created for you is yours. Standard and Design + Build plans and all Sprints include Figma source files, and Sprints include the full source code.
Full-stack development is included only in the Design + Build plan and the Product Sprint; Starter covers site updates and content changes, and Standard covers front-end development. 3D animation and video production are outside the scope of these services. If you're unsure whether something is covered, just ask.
To keep things moving smoothly, you're responsible for providing necessary assets, content, and brand guidelines, as well as timely feedback on deliverables.
My services are provided "as is." I am not liable for any indirect, incidental, or consequential damages arising from the use of my services. My total liability is limited to the amount paid for the current billing cycle or, for a Sprint, the Sprint fee paid.
I may update these terms from time to time. If changes are significant, I'll notify active subscribers and anyone with a Sprint in progress before they take effect. A Sprint already booked stays under the terms in place when it was booked.
